DMCA Policy

1. Overview
NullBot Themes ("we," "us") respects the intellectual property rights of others and expects our users and developers to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using our service.
2. Filing a DMCA Takedown Notice
If you believe that content available on NullBot Themes infringes your copyright, you may submit a written DMCA takedown notice to our designated agent. Your notice must include the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
- Identification of the copyrighted work you claim has been infringed
- Identification of the material that you claim is infringing, with enough detail so that we can locate it on our platform (e.g., the theme name, URL, or slug)
- Your contact information, including your name, address, telephone number, and email address
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf

4. Our Response
Upon receiving a valid DMCA takedown notice, we will:
- Promptly remove or disable access to the allegedly infringing material
- Notify the developer who submitted the content of the takedown
- Provide the developer with a copy of the notice (with your personal address redacted if requested)
5. Counter-Notification
If you are a developer who believes your content was removed in error or due to misidentification, you may file a counter-notification. Your counter-notification must include:
- Your physical or electronic signature
- Identification of the material that was removed and its location on our platform before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
- Your name, address, and telephone number
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, and that you will accept service of process from the party who filed the original DMCA notice
Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10-14 business days, we may restore the removed material.
6. Repeat Infringers
We maintain a policy of terminating the accounts of developers who are repeat infringers. If a developer receives multiple valid DMCA takedown notices, their account may be permanently suspended and all themes removed from the marketplace.
7. Good Faith
Please be aware that filing a false DMCA notice may result in legal liability. Before submitting a takedown notice, please consider whether the use of the copyrighted material may qualify as fair use or whether you are the actual rights holder. We recommend consulting a legal professional if you are unsure.
